Why was the NFA passed?
To fight the gangland violence of the Prohibition era. The St. Valentine’s Day Massacre and the 1933 attack on President-elect Roosevelt pushed Congress to tax machine guns, short-barreled guns and silencers in 1934.
Is the $200 tax stamp gone?
For suppressors, SBRs, SBSs and AOWs, the tax has been $0 since January 1, 2026. Machine guns and destructive devices still carry the $200 tax.
Do I still need a Form 4 for a suppressor?
Not under federal policy since October 9, 2026, but your state may still require one. Your dealer will know.
Is the NFA repealed?
No. The law is still on the books. ATF chose not to enforce parts of it for the four $0 items after a court ruling. That policy could change.
Should I keep my registered items registered?
That is a personal call. Removal from the registry is permanent unless an amnesty is declared, and some states still require registration.
Can I buy a new machine gun?
No. Only machine guns registered before May 19, 1986 can be owned by private citizens.
Can I travel with my SBR?
Yes, after ATF approves a Form 20. That rule still applies to SBRs and SBSs, registered or not.
